Welcome to SIFANET SYSTEMS Ltd. By accessing or using our website, products, or services, you agree to be bound by these Terms of Service. Please read them carefully.
1. Acceptance of Terms
By using this website and our services, you confirm that you are at least 18 years old and legally capable of entering into binding agreements. If you are using our services on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.
2. Our Services
SIFANET SYSTEMS Ltd provides security and technology solutions including CCTV systems, smart locks, electric fencing, alarm systems, access control, solar power installations, and related professional services. Specific service terms, pricing, warranties, and project timelines are detailed in individual quotations and contracts.
3. Quotations and Contracts
All quotations are valid for 30 days from the date of issue unless stated otherwise. Acceptance of a quotation and payment of the agreed deposit constitutes a binding contract between SIFANET and the client. Variations to the agreed scope must be documented in writing and may result in additional charges.
4. Payment Terms
Unless otherwise agreed in writing, our standard payment terms require a 60% deposit upon contract signing, with the balance payable on completion. Invoices are payable within 14 days of the completion date. Late payments may attract interest at 2% per month. We accept payment via bank transfer, M-Pesa, and other approved methods.
5. Installation and Commissioning
All installations are carried out by certified technicians in accordance with manufacturer specifications and applicable Kenyan regulations. Clients are responsible for providing safe site access, a suitable power supply, and any required permits (e.g. landlord approvals). Installation timelines are estimates and may be affected by factors outside our reasonable control.
6. Warranties
SIFANET provides a standard 12-month workmanship warranty on all installations, covering defects in labour. Equipment warranties are passed through from the manufacturer and vary by product. Warranty claims must be raised in writing within the warranty period. The warranty does not cover damage caused by misuse, unauthorised modification, power surges, lightning strikes, theft, or acts of God.
7. Client Responsibilities
Clients are responsible for the ongoing use, supervision, and basic maintenance of installed systems, including changing user codes, updating contact lists, replacing batteries where applicable, and notifying SIFANET of faults promptly. Failure to exercise reasonable care may void the warranty.
8. Data Protection and Privacy
Our handling of personal data — including CCTV footage, access logs, and client contact information — is governed by our Privacy Policy and the Kenya Data Protection Act, 2019. By using our services, you consent to the processing of personal data as described in our Privacy Policy.
9. Limitation of Liability
To the maximum extent permitted by law, SIFANET's total liability arising from any single contract shall not exceed the value of that contract. SIFANET shall not be liable for indirect, incidental, or consequential damages, including but not limited to loss of profits, business interruption, or data loss, save where such limitation is prohibited by law.
10. Monitoring Services
Where SIFANET provides monitoring or response services, our obligation is to monitor alerts and coordinate an appropriate response in accordance with the agreed service level. We do not guarantee that every incident will be detected or prevented, and response times depend on factors including traffic, location, and third-party response providers.
11. Intellectual Property
All website content, designs, documentation, and branding remain the intellectual property of SIFANET SYSTEMS Ltd. You may not reproduce, modify, or distribute our content without prior written consent.
12. Termination
Either party may terminate an ongoing service contract with 30 days' written notice. SIFANET reserves the right to suspend services immediately in cases of non-payment, breach of these terms, or illegal use.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Kenya. Any disputes shall be subject to the exclusive jurisdiction of the Kenyan courts, with mediation attempted in good faith before litigation.
14. Changes to These Terms
SIFANET may update these Terms from time to time. Material changes will be notified via our website and, where relevant, directly to active clients. Continued use of our services after changes constitutes acceptance of the revised Terms.
